JUDGEMENT

(1.) Heard counsel for the parties.

(2.) The petitioner in this writ application has prayed for a direction upon the respondents, restraining them from making recovery of any amount from his retiral benefits on the plea of excess payments received by the petitioner and further, for a direction to pay him the admissible retiral benefits along with statutory and penal interest on the delayed payments which has been withheld ever since the date of petitioner's retirement in 2002.

(3.) It is informed by the counsel for the petitioner that during the pendency of this writ application, and considering a similar issue decided by this Court in the case of Deo Lal Singh Vs. State of Jharkhand & Ors., vide W.P.(S) No. 4590 of 2004, the respondents have since released and paid to the petitioner the entire retiral dues, sometime in the month of February, 2009, but no amount of interest has been paid by them on the delayed payments.
