JUDGEMENT

(1.) Heard learned counsel for the petitioner and learned counsel for the State.

(2.) This is an application for grant of regular bail to the petitioner for the offence under Sections 419/420/467/468/470/471/120B/384 of the Indian Penal Code.

(3.) It is submitted by learned counsel for the petitioner that as per the F.I.R. the main accused is Tuka Ram Namdeo, who has taken money for providing employment in the Railway Department. Apart from him other named accused persons are Karan Nagley, Ajay Kumar Dubey, Indra Bhan Choudhary and Sunil Kumar Hathiya. It is further submitted by learned counsel for the petitioner that petitioner is not named in the F.I.R. and subsequently, his name was included by the statement of some other witnesses and the named accused persons namely Tuka Ram Namdeo has been granted bail by a Bench of this court vide order dated 12.01.2009 in B. A. No. 1155 of 2008. Petitioner is in custody since 31.07.2010. Learned counsel for the State opposed the prayer for bail, but admits that named accused person has already been granted bail. In the facts and circumstances of the case and since, named accused has already been granted bail, petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/( Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Dhanbad in connection with Dhanbad G.R.P.S. Case No. 69 of 2007 corresponding to G. R. Case No. 124 of 2007, subject to the condition that one of the bailers should be the local residents having property within the jurisdiction of the court.
