JUDGEMENT

(1.) Both the writ petitions have been heard together and are being disposed of by this common order.

(2.) The main grievance of the petitioner in both the writ petitions is that her husband Late Mathura Pandey, who was a driver working with the Central Coalfields Limited died on 02/10/1995 while in service. Her grievance is that she has neither been provided the retiral benefits nor appointment on compassionate ground. It is stated that though she had applied for appointment on compassionate ground but the same was rejected on the ground of delay by an order dated 26/02/2002 (Annexure4) and even a petition filed by way of appeal was also rejected on 29/06/2004 vide Annexure6.

(3.) In view of the judgment of the Division Bench of this Court in the case of "Satnarayan Choudharyversus Central Coalfields Limited & Ors reported in 2009 (1) JCR 654 (Jhr.)" the rejection of the claim of the petitioner for compassionate appointment on the ground of delay cannot be sustained and the matter has to be reconsidered by the respondents C.C.L. on the basis of the aforesaid judgment of the Division Bench.
