JUDGEMENT

(1.) Heard the parties.

(2.) This appeal is directed against the judgment dated 26.7.2006 passed in CWJC No.3400/1999R, whereby the learned Single Judge disposed of the writ petition with certain directions.

(3.) It appears that the respondent, Ramanand Kumar Savita, was a constable under the Central Industrial Security Force, Unit Bokaro Steel Limited, Bokaro. He was subjected to a departmental proceeding on the charge of theft of brass component, while on duty. After holding the respondent guilty of the charge, an order of dismissal from service was passed. The said order of dismissal was challenged in the writ petition. The learned Single Judge found that the punishment of dismissal awarded to the respondent is excessive and disproportionate to the charges levelled against him. Accordingly the order of dismissal was set aside and the matter was remanded back to the disciplinary authority for imposing lesser punishment. Hence this appeal by the appellant.
