BY filing this interlocutory application it is stated that appellant no. 8 namely, Mahesh Harizan died during pendency of this appeal on 15.7.2007 leaving behind Budhia Devi, wife, Kalpana Kumari, daughter, Bipin Harizan, minor son as his heirs/legal representatives. It is also stated that the heirs were not knowing about the pendency of this appeal before this Court and, therefore, they could not take appropriate steps for .substitution within time.

(3.) I .A. No. 2733 of 2009 stands disposed of.
