JUDGEMENT

(1.) This writ petition has been filed against the order dated 14.7.2009 passed by 2nd Additional Munsif, Ranchi in Title (Eviction) Suit No. 2 of 2006 allowing the amendment of the plaint.

(2.) It is submitted on behalf of the petitioner that after about five months of framing of issues, such amendment was allowed. He relied on the judgment of the Supreme Court in Vidyabai and Others V/s. Padmalatha and Another, 2009 AIR(SC) 1433).

(3.) Mr. Ashutosh Anand, counsel appearing for the respondent, submitted that in view of the growing necessity, such amendment was necessary.
