(1.) This is an appeal by the plaintiff Sudhir Chandra Dass against the judgment of my learned brother Mr. Justice C. C. Ghose which was delivered on the 12 of March 1924.
(2.) The facts of this case are, I hope, entirely out of the ordinary at all events, as far as my experience goes, they are unprecedented.
