(1.) NIYOGI , A.J.C. 1. It is urged that there was no public nuisance to attract the provisions of Section 133, Criminal P.C. There is very clear evidence to show that the noise of the mill causes discomfort to the residents of the locality. There is no substance in this contention. The applicant prays for changing the hours of cessation of work from 9 p.m. to 6 a.m. to 10 p.m. to 7 a.m. I think this prayer is not unreasonable. I however do not desire to interfere in the absence of definite information about the local conditions. The Magistrate will no doubt consider this request if the applicant represents his case properly to him. The application is dismissed.
