(2.) The outstanding question is as to the costs of the reference as to title.
(3.) The short facts are as follows: Defendant 1 contracted to sell the property in question by certain terms of settlement, dated 6 April 1923, subject to approval of title by the plaintiff's solicitors and free from all emcumbrances, for a price of Rs. 38,000.
