MAYAPPA Vs. A NARASHIMASWAMY

JUDGEMENT

(1.) APPEAL No. 542 of 2008 is by the complainant and Appeal No. 914 of 2008 is by the O.P. challenging the impugned order of the DF, Mandya in Complaint No. 91 of 2007 to the extent they are aggrieved.

(2.) THE complainant approached the O.P. with a complaint of fever on 15.12.2004 thinking that the O.P. is an MBBS doctor and he is qualified to give treatment relying upon the pamphlet distinguished at Megalapura Circle, Malavalli tq.

(3.) THE O.P. after examination gave one injection to the complainant and also prescribed the tablets advising him to take the same. As the fever was not subsidized again went to the clinic of the O.P. But unfortunately on that day the clinic was closed. Thereafter the complainant went to Government Hospital, Malavalli. But the surgeon in the said Government Hospital was not available.
