JUDGEMENT

(1.) Heard Mr Arunkumar Doddla, learned counsel appearing on behalf of the petitioner and Mr P.Ajith Varma, learned counsel appearing on behalf of the respondents.

(2.) This civil revision petition is filed challenging the propriety and legality of the order dtd. 23/8/2023 in I.A.No.703/2023 in O.S.No 141 of 2020, whereby the Court of Principal Junior Civil Judge, Mancherial dismissed the petition filed under Order 38 Rule 5 of C.P.C. filed by the petitioner/plaintiff.

(3.) For the sake of convenience, the parties herein are referred to as they are arrayed in the suit before the lower Court.
