This Criminal Petition is filed under Sec. 482 Cr.P.C. by the petitioner-accused No.1 to quash the proceedings against him in F.I.R.No.694 of 2022 on the file of Jagadgirigutta Police Station, Cyberabad, registered for the offences punishable under Ss. 417, 420, 468, 467 and 506 read with Sec. 34 I.P.C.
(2.) The brief facts, as culled out from the complaint, are that the husband of the second respondent viz., Late Tummala Venkata Ratnam along with three others namely Smt. Shaik Kausar Jan, Sri Koripilli Venkat Rao and Sri Genikala Kishore, jointly purchased the land, admeasuring 14,036 square yards in Survey Nos.291 and 292, situated at Kukatpally Village and Municipality vide registered document No.1731 of 2009 dated 03. 06.2009 from its lawful owners. It is further alleged in the complaint that on 1/9/2020, the husband of the second respondent died due to Covid, 2019 virus leaving behind her and her two sons; that recently, she came to know that the petitioner is claiming to be the Director of Bhavya Constructions Private Limited, and trying to start construction work in the subject land; that the partners of her husband allegedly colluded with the petitioner and executed false and fake documents vide registered document Nos.7643/2014 (Agreement of Sale-cum-General Power of Attorney with possession) and No.7642/2014 (sale deed) without separation and demarcation of her husband's share. It is further alleged in the said complaint that though the name of late husband of the second respondent was mentioned in the document Nos.7643/2014 and 7642/2014, the said documents neither contain his signature nor photographs; that when the second respondent tried to discuss the matter with the help of elders, the accused assaulted her in filthy language and offered nominal amount and also threatened her and her family members with dire consequences.

It is further alleged in the complaint that the partners of the second respondent's husband in collusion with the petitioner are trying to deprive the right of the second respondent in her husband's legitimate share over the subject land and thereby, they committed the offences of cheating, assault, blackmail and threatening.
