JUDGEMENT

(1.) The appellants are questioning their conviction under Sec. 304-B of IPC in S.C.No.509 of 2014, wherein the 1st appellant was sentenced to undergo Rigorous Imprisonment for a period of 10 years and 2nd appellant was sentenced to undergo Rigorous Imprisonment for a period of 7 years.

(2.) The case of the prosecution is that P.W.1, who is the father of the deceased married his daughter to the 1st appellant by giving cash of Rs.20,000.00, 1 1/2 tulas of gold, gold ear studs and silver hanklets towards the agreed amount of Rs.1,20,000.00 as dowry. After the marriage, couple lived happily for a period of one year and blessed with two sons. The incident took place on 27/7/2013. Two years prior to the incident, both the appellants started harassing the deceased physically and mentally demanding to pay an amount of Rs.2,00,000.00 as additional dowry. P.W.1 approached the appellants and agreed to pay demanded additional dowry. 20 days prior to the incident, the deceased was sent away by the appellants for bringing additional dowry. P.W.1 and P.W.4 pleaded with the appellants not to harass the deceased and agreed to pay Rs.1,00,000.00 within a short period and sent the deceased to the home of the appellants.

(3.) Further, on 26/7/2013 during night hours, the deceased committed suicide. The deceased committed suicide in the residence of the appellants, the appellants tried to rescue her on seeing her hanging. However, the deceased died by that time. On receiving information, P.W.1 along with others went to the residence of the appellants and upon enquiry from the neighbours, they came to know that the deceased was beaten indiscriminately during the day and unable to bear the said harassment, she committed suicide. On the said information, as seen from the endorsement Ex.P1, P.W.1 filed a written complaint Ex.P1 to the police, which was received on 27/7/2013 at 8.00 A.M.
