JUDGEMENT

(1.) This Civil Miscellaneous Appeal is filed assailing the order dtd. 29/1/2018 in IA No.1105 of 2016 in OS No.162 of 2016 on the file of the II Additional District Judge at Warangal.

(2.) This IA No.1105 of 2016 was filed under Order-39, Rules-1 and 2 read with Sec. 151 of the Civil Procedure Code, 1908 (for short 'CPC') by the petitioner/plaintiff against the respondent/defendant. Feeling aggrieved by the dismissal of said application, the plaintiff has filed this Civil Revision Petition.

(3.) For the sake of convenience, the parties are hereinafter referred to as plaintiff and defendant as arrayed in the original suit.
