JUDGEMENT

(1.) This Writ Petition is filed by the petitioner under Article 226 of the Constitution of India seeking a Writ of Mandamus to declare the action of 2nd respondent in not permitting / allowing the petitioner for first and second phase of counselling for admission into M.B.B.S. / B.D.S. Courses for the Academic Year 2022-23 under Management Quota, i.e., 'B' Category in private un-aided non-minority / minority medical colleges and private un-aided dental colleges, army dental college affiliated to the 2nd respondent-University as unjust, arbitrary and unconstitutional.

(2.) Heard Mr.D. Narendar Naik, learned counsel for the petitioner; the learned Government Pleader for Medical, Health and Family Welfare, for the 1st respondent; and Mr. A. Prabhakar Rao, learned Standing Counsel for the respondent nos.2 and 3.

Learned counsel for the petitioner contended that petitioner has appeared for the National Eligibility-cum-Entrance Test, 2022 (Under-Graduate) and secured a decent rank; thereafter, the petitioner has responded to notification dtd. 19/10/2022, issued by the 2nd respondent-University, for admission into M.B.B.S. / B.D.S. Course for the Academic Year 2022-23 under 'B' and 'C' seats in Management Quota; however, at the time of exercising web options, the petitioner could not exercise the web option as the petitioner was hospitalized due to Dengue fever; immediately, petitioner submitted a detailed representation to the 2nd respondent-University on 6/12/2022, requesting the 2nd respondent-University to permit the petitioner to exercise web options; but the 2nd respondent-University has not passed any orders on the representation dtd. 6/12/2022 submitted by the petitioner; and therefore, prayed this Court to pass appropriate orders in the Writ Petition by directing the 2nd respondent-University to consider the representation submitted by the petitioner dtd. 6/12/2022 and pass appropriate orders thereon in accordance with law
