(1.) Challenge in these Criminal Petitions are the charge sheets and the First Information Reports which were registered alleging that the respective petitioners committed offences punishable under Ss. 188, 269, 270, 271, 272, 273, 328, 336 and 420 IPC. The allegation is also that the petitioners committed offences under the provisions of the Cigarettes and Other Tobacco Products (Prohibition of Advertisement and Regulation of Trade and Commerce, Production, Supply and Distribution) Act, 2003 (hereinafter be referred to as "the COTP Act, 2003", for brevity) and that, S.59 (1) of the Food Safety and Standards Act, 2006, is violated. Though not collectively, for the said offences, different provisions of law were quoted basing on different set of case facts, however, regarding the same subject matter.
