(1.) This Writ Petition is filed questioning the order of the 1st respondent dtd. 14/2/2022 whereby the order passed by the 2nd respondent dtd. 5/9/2020 refusing to renew the licence is confirmed.
(2.) Sri Mohd. Abdul Mateen Qureshi, learned counsel for the petitioner submits that initially, the petitioner has approached the Commissioner of Police, who, vide proceedings, dtd. 5/9/2020 cancelled the Arms Licence No. 77/Chatrinaka as the licensee is not having any threat perception. It is stated that the petitioner carried the matter by way of Appeal to the 1st respondent government. By order dtd. 14/2/2022, the appellate authority " " government dismissed the said Appeal on the ground that there is no threat perception. Learned counsel submits that the renewal of arms licence is governed by Sec. 17(3) of the Arms Act and as per the same, there is no such ground available to the respondents. According to the learned counsel, the ground that the petitioner has no threat perception does not form part of Sec. 17(3) of the Act. He also relied on the orders of this Court in K. Raghavendra Rao v. State of Telangana,2019(5) ALD 206 (TS).
