JUDGEMENT

(1.) This Writ Petition is filed to declare the action of the respondents in not releasing Maruti Suzuki Dzire car bearing registration No.AP-29AD-6021 belonging to the petitioner seized in connection with Crime No.59 of 2020 on the file of Kamalapur Police Station, Warangal Urban District, for the offences punishable under Sections 269 of IPC and Section 34(a) of the Telangana State Excise Act, 1968, as illegal and arbitrary.

(2.) Heard learned counsel for the petitioner and the learned Government Pleader for Prohibition and Excise.

(3.) The case of the petitioner is that he is the owner of Maruti Suzuki Dzire car bearing registration No.AP-29AD6021, which was purchased in the year 2008 and he is using the same for his personal use. He further states that the third respondent seized the vehicle on the ground that he is transporting liquor bottles illegally.
