CHANDRA PRAKASH MEHRA Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) A FIR No. 144/99 dated 10.11.99 was registered with the Police Station Mahesh Nagar, Jaipur city for offences under Sec. 376 and 306 I.RC. The petitioner is praying that a direction be issued to the Investigation Officer to investigate the case in light of the facts as brought out in Annex. 3 and 4 by considering the affidavits of certain persons.

(2.) It is alleged that one Miss Sunita D/o Shri Badri Narayan had committed suicide on 4.11.99. It is alleged that some conspiracy was hatched to involved the petitioner because of the reason that father of the petitioner had been making complaints against anti-social elements as residents of father of the deceased. It is stated that father of the petitioner Shri Mam Chand also made a complaint on 10.11.99 to the Superintendent of Police. The bail application of the applicant was rejected. Certain representations were submitted to the Police Officer. It is further stated that 25 residents of Patel Nagar gave their statements on the affidavits whose name have been mentioned in the misc. petition to the effect that there was certain enemity between the family of the deceased girl and the petitioner and further the petitioner had been falsely involved.

(3.) The prayer made in the petition is that the Investigation Officer be directed to investigate the matter in regard to the suicide/murder of Miss Sunita on the basis of affidavits filed by certain persons, copy of which have been attached with the misc. petition.
