JUDGEMENT

(1.) IS this Court bound to interfere with each and every order passed by subordinate authority in its powers under Article 226/227 of the Constitution of India?" Answer to this question is no.

(2.) THE petitioner has challenged in this petition, which is filed under Article 226/227 of the Constitution of India, the impugned order at Annex. 4 dated 15. 4. 1998 passed by the Addl. Divisional Commissioner in exercise of his powers under Section 300 of the Municipality Act, 1959 remanding the matter to the Municipality to decide the case afresh after extending an opportunity to both the petitioner as well the contesting respondent No. 4.

(3.) IN view of the above discussion, I do not see any reason to interfere with such remand order in this writ petition in exercise of my powers either under Article 226 or 227 of the Constitution of INdia. Hence, this petition fails and is hereby dismissed. Stay, if any, granted earlier stands vacated forthwith. .
