JUDGEMENT

(1.) This revision petition was admitted on the question of sentence subject to the objection of limitation. The revision was presented on 1.2.78. when it was barred by two days and an application for condonation of delay has been filed. For the reasons stated in the same. I consider it proper to condone the delay. The delay in filing the revision petition is accordingly condoned.

(2.) As regards the sentence, the learned counsel for the petitioner submits that the petitioner would complete his substantive sentence on 20.2.79. He only prays that the sentence of fine of Rs. 1000.00 is excessive. In my opinion, the sentence of fine of Rs. 100.00 would meet the ends of justice.

(3.) The revision petition is accordingly partly allowed while maintaining the conviction of the petitioner. His sentence is modified to this extent that sentence of fine of Rs. 1000.00 is reduced to a fine of Rs. 100.00. In default of payment of fine, the petitioner shall undergo one month's rigorous imprisonment. Petition partly allowed.
