JUDGEMENT

(1.) Heard learned counsel for the parties.

(2.) Undisputed position is that the admit card of the appellant requiring him to be present at Jaipur to undergo the physical efficiency test on 7.9.2018 was uploaded in the evening of 6.9.2018. The appellant resides in village Nokha district Bikaner and had to travel over-night to reach Jaipur.

(3.) On 14.11.2018 allowing D.B.Civil Special Appeal (Writ) No.1732/2018 Thawara Ram V/s State of Rajasthan and ors. it was held as under:-
