JUDGEMENT

(1.) The instant leave to appeal application has been preferred by the State of Rajasthan under Section 378 (iii) and (i) Cr.P.C. for assailing the judgment dated 06.02.2018 passed by the learned Additional Sessions Judge, (Woman Atrocities Cases), Udaipur in Sessions Case No. 45/2017 whereby, the respondents were acquitted of the charges under Section 363, 366 read with Section 120B, Section 370 read with Section 120B IPC.

(2.) The appeal is delayed by 85 days. An application under Section 5 of the Limitation Act has been moved by the State of Rajasthan to condone the delay.

(3.) I have heard the contentions of the learned Public Prosecutor on the aspect of the condonation of delay and also on the merits of the case.
