(1.) The issue in this petition is with regard to the petitioner's eligibility to be considered for appointment as Teacher Grade-III Level-I pursuant to the advertisement dtd. 12/4/2018.

Mr. Ram Pratap Saini counsel for the petitioner submitted that this petition be disposed of in terms of the judgment passed by the Principal Seat of this Court at Jodhpur in the case of Ranjana Chaturvedi v. The State of Rajasthan and Others SBCWP No. 12471/2017 decided on 7/5/2018. He submitted that following the judgment passed in Ranjana Chaturvedi v. The State of Rajasthan and Others (supra) this Court had similarly disposed of other writ petition i.e. Rajaram Choudhary and others v. State of Rajasthan and Another SBCWP No. 18599/2018 and other connected matters on 20/11/2018. Mr. Ram Pratap Saini submitted that this petition be also similarly disposed of.
(3.) Mr. Aaditya Sharma, Dy. GC for the respondent- State submitted that neither the case of Ranjana Chaturvedi (supra) nor of Rajaram Choudhary and others v. State of Rajasthan and Another (supra) have been correctly decided. He submitted that recruitments to the post of Teacher Grade-III Level-I effective 2017 are not being held through a written examination. Assuming that the provision to Rule 266 (3) of the Rajasthan Panchayati Raj Rules, 1996 (hereafter 'the Rules of 1996') still attracts to such recruitment as held by this Court in the case of Trilok Ram v. The State of Rajasthan and other connected matters decided by the Division Bench of the Principal seat of this Court at Jodhpur (DBSAW No. 667/2015) on 18/8/2017, it would have no effect on the date of eligibility for applying to the post of Teacher Grade III Level-I pursuant to the advertisement dtd. 12/4/2018. This for the reason that recruitment to the post of Teacher Grade-III Level-I is no longer based on a competitive examination but based on merit of competing applicants on the basis of marks at the Senior Secondary Level and RTET/ REET.
