(1.) The present special appeal has been filed by the appellant- writ petitioner against the order passed by the learned Single Judge dated 05.09.2019 dismissing the writ petition filed by the appellant-petitioner.
(2.) The case set up by the appellant-writ petitioner before the learned Single Judge is that he is son of the deceased government servant namely Hari Kishan, who died while in service. The deceased employee Hari Kishan married to Smt. Uganti Devi and out of this wedlock four children were born including the petitioner, however, Smt. Uganti Devi died on 10.02.1999 and thereafter the deceased employee remarried to Smt. Laxmi Kishan, respondent no.5, herein, in 2001 and out of this wedlock one son was born. The petitioner further averred that family pension and other retiral benefits death-cum-gratuity were released to respondent no.5 Smt. Laxmi Kishan and while making reference of some settlement arrived at between the parties claimed appointment on compassionate grounds in his favour.
(3.) The petitioner further urged before the learned Single Judge that the respondent no.5 Smt. Laxmi Kishan has deviated from the settled arrived at between them and applied for the post on compassionate ground and orders have also been issued by the concerned department for consideration of appointment of respondent no.5 on the compassionate grounds.
