KAMRUDDIN Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) The instant writ petition has been filed by the petitioner challenging the notice dated 26th July, 2019, whereby the Assistant/Mining Engineer (Recovery), Mines and Geology Department, Bharatpur has asked the petitioner to deposit the outstanding amount.

(2.) Learned counsel submitted that the petitioner has already deposited the complete amount of royalty with the Mines Department and the respondents have already refunded the security, deposited by the petitioner by issuing the order, which is marked as Annexure - 1 in the writ petition.

(3.) Learned counsel for the petitioner submitted that now after more than three years from the date of completion of the work, the impugned notice of recovery for depositing the amount of Rs. 83063/- and Rs. 9,763/- towards royalty has been issued.
