SHANKARNATH Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) The present bail application has been filed under Sec. 439 Cr.P.C. The petitioner has been arrested in connection with FIR No. 342/2018 registered at Police Station Kardhani District Jaipur for the offence(s) under Ss. 457 and 380 of IPC.

(2.) Counsel for the petitioner submits that co-accused Ramphool Nath has already been released on bail by the Co-ordinate Bench of this court vide order dtd. 25/1/2019 passed in S.B. Criminal Misc. Bail Application No. 1069/2019. Counsel further submits that his case is similar to Ramphool Nath and no recovery is due to be made from the petitioner.

(3.) Learned Public Prosecutor has opposed the bail application.
