This Court by order dated 13.7.2015 while disposing of the writ petition directed the Rent Tribunal to decide the main eviction petition along with all other interlocutory applications within a period of four months from the date next fixed before it. It was specifically directed that in view of the mandate of Rajasthan Rent Control Act, 2002, the eviction petition should be decided in a time bound manner along with all other interlocutory applications, which are filed with the main eviction petition.
(2.) It is surprising to note that the order aforesaid has not been complied with as yet. The Presiding Officer of the Rent Tribunal sent a letter to this Court on 5.4.2016 for extension of time. Perusal of the letter shows that the Presiding Officer stated that he received copy of the order of this Court dated 13.7.2015 belatedly on 2.4.2016, which is again a surprising fact. The matter on that letter was listed before the Court belatedly on 20.10.2016. Already a period of six months had gone by that time, even then this Court extended further time by six months vide order dated 20.10.2016.
(3.) Be that as it may, by virtue of order of this Court dated 20.10.2016, extension of time by six months would count from the date of the aforesaid order dated 13.7.2015, amounted to extending time by one year.
