SADDAM Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) Saddam @ Lala S/o Ummed Khan, Prakash @ Yuvraj S/o Bhanwar Singh and Ramavatar @ Ramu S/o Damodar Soni were tried by the Court of Special Judge, Scheduled Caste and Scheduled Tribe (Prevention of Atrocities Cases), Ajmer. The said Court vide impugned judgment dated 24.09.2016 convicted Saddam @ Lala and Prakash @ Yuvraj Singh for offences under Sections 364, 302, 201 IPC and Section 3(2)(v)(vi) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act. Having convicted appellants Saddam @ Lala and Prakash @ Yuvraj Singh for above-said offences, the trial Judge vide separate order of even date sentenced them as under:-

(2.) Third accused Ramavtar @ Ramu S/o Damodar Soni was only convicted for offence under Section 411 IPC for having received the stolen articles. The said Court vide impugned judgment dated 24.09.2016 sentenced Ramavtar @ Ramu S/o Damodar Soni to undergo two years simple imprisonment and to pay a fine of Rs.2,000/-, in default thereof to undergo additional two months simple imprisonment.

(3.) Aggrieved against the conviction and sentence, Saddam @ Lala has preferred D.B. Criminal (Jail) Appeal No.156/2017, Prakash @ Yuvraj Singh instituted D.B. Criminal(Jail) Appeal No.157/2017, whereas Ramavtar @ Ramu filed S.B. Criminal Appeal No.1162/2016. Because of the connected appeals being listed before the Division Bench, S.B. Criminal Appeal No.1162/2016 is also listed before us.
