These writ petitions involve challenge to determination of wards of various Panchayat Samitis, vide order dated 29.11.2019, notified by the Collector in exercise of powers available to him under Rules 3 and 4 of the Rajasthan Panchayati Raj (Election) Rules, 1994 (hereinafter referred to as 'the Rules of 1994').
(2.) At the outset, objections with respect to maintainability of the present writ petitions before this Court (Single Bench), have been raised by the learned Additional Advocate General. As such, before entering into the merits of the rival contentions, this court deems it appropriate to decide the question of jurisdiction of this Court while sitting singly.
(3.) Learned Additional Advocate General, firstly submitted that since the impugned order dated 29.11.2019, issued by the District Collector, in exercise of the powers under sub-rule (4) of Rule 4 of the Rules of 1994 is legislative in nature, having regard to the order dated 10.03.2011 issued by the Chief Justice (on 28.02.2011) and subsequent clarification issued on 18.03.2011, the validity of such order, is required to be examined by a Division Bench.
