JUDGEMENT

(1.) The present bail cancellation application has been filed by the petitioner-complainant for cancellation of bail granted by this Court to the accused-respondent No.1 vide order dated 09.04.2019 passed in S.B. Criminal Misc. Bail Application No.13208/2018 which reads as under:-

Counsel for the petitioner-complainant submits that on the date of granting bail to the accused-respondent counsel for the complainant was absent and the order dated 09.04.2019 was passed in the absence of the counsel for the complainant. Counsel further submits that the statement of the prosecutrix has been recorded by the learned trial Court as PW1 wherein she has specifically stated that the accused-respondent has committed rape on her. Counsel further submits that the accused-respondent is regularly harassing the petitioner-complainant after granting bail by this Court.

(3.) Learned Public Prosecutor submits that the statement of the prosecutrix has been recorded by the learned trial Court and the learned trial Court may be directed to expedite the trial. Heard counsel for the parties and perused the material available on record. The order dated 09.04.2019 was passed by this Court granting bail to the accused-respondent under Section 439 Cr.P.C. on merits after considering the material available on record and after hearing the learned Public Prosecutor and on the said date counsel for the complainant was absent.
