JUDGEMENT

(1.) Petitioner has preferred this misc. petition wherein limited prayer is made that benefit of Section 12 of the Probation of Offenders Act, 1958 be given to the petitioner.

(2.) It is contended by counsel for the petitioner that petitioner was convicted under Motor Vehicle Act and the Court has given benefit of Section 3 of the Act of 1958. It is contended that in the order dated 20.09.2017, it is not mentioned that conviction would not be a disqualification.
