JUDGEMENT

(1.) By way of this Writ (PIL) Petition, the petitioners have prayed for a direction to the respondents authorities to take steps to remove encroachment from all government land/'charagah' land situated at village Moondiya, Tehsil Lalsot, District Dausa, with immediate effect by holding liabilities of responsible persons as per law in the interest of general public.

(2.) Contention of learned counsel for petitioners is that various villagers of village Moondiya made encroachment in 'charagah' land/government land of various khasra numbers. The land of khasra nos.62, 160, 161, 163, 164, 200/15 measuring 221.16 bigha has been recorded as government land in village Moondiya and certain unsocial elements including respondents no.4 to 11 have encroached upon the government land situated in village Moondiya, Tehsil Lalsot, District Dausa and made an obstruction on the public path of the village while the said land was kept for grazing of animals since a long time. There were so many trees on the land but some persons made encroachment by constructing houses and well and got electricity connections in illegal manner. It is further submitted that way back in the year 2011, certain villagers had also complained to competent authority regarding illegal encroachment but no concrete action was taken by the competent revenue authorities.

(3.) It is also stated that this matter was connected with D.B. Civil Writ Petition (PIL) No.11923/2018, wherein some of the necessary parties were same as in the present matter. In the above noted writ petition, a complaint was submitted by the general public of village Moondiya to the District Collector, Dausa, on 15.09.2011, however, khasra numbers were not mentioned in the said writ petition. It is also submitted that D.B. Civil Writ Petition (PIL) No.11923/2018 has already been disposed of by a coordinate bench of this court vide order dated 24.01.2019 directing that the permanent structure on the land be demolished within six weeks and in future nobody is allowed to plough the land and cultivate the same.
