(1.) This Court passed a detailed order on 28/08/2019 after hearing submissions made by the learned counsel appearing for parties of both sides. Shri N.K. Maloo, learned senior counsel appearing on behalf of the University informed the court that pursuant to the Resolutions of the Syndicate dated 08/08/2019 and 10/08/2019, the Vice Chancellor of the University vide order dated 24/08/2019 has constituted a Committee headed by Professor Alpana Kateja with three other members to examine the matter of giving benefits of CAS to retired as well as working teachers in different subjects from the initial date of appointment as per the directions of this Court. It was submitted that since the total number of claimants are 272 in number, the respondent-University shall require the sanction of budget from the State Government and only thereafter they could be in a position to make payment of dues and that could however be done only after the case of either of the claimants is scrutinized and computation of payable amount is made.
(2.) Taking note of the aforesaid submission made on behalf of the University, this Court directed the respondents that even if the compliance is made, if not at one go, in a phased manner, first of all the case of the 18 petitioners should be considered.
(3.) Today, Mr.N.K. Maloo, learned senior counsel appearing for the University has given an entirely different picture of the problem. He submits that the Committee that was constituted by the Vice Chancellor vide order dated 28/04/2019 referred to supra, was meant to evaluate the over all situation and the steps required to be taken. Since 18 petitioners in the present matter are from different subjects, the Committee envisaged under Ordinance 141C of the University Ordinances read with Section 5 of the Rajasthan University Teachers and Officers (Selection for Appointment) Act, 1974, would have to be constituted subject- wise. Considering that 32 subjects are involved, this would require atleast a month's time to complete that process.
