JUDGEMENT

(1.) The present petition has been filed by the petitioner challenging the order dt.04.10.2019 whereby the Board of Revenue while entertaining the appeal, has passed an order of staying the operation of order passed by the Tehsildar, Amer dt.19.03.2012 and the order dt. 02.04.2019 passed by the Divisional Commissioner and further directed the parties to maintain status-quo in respect of revenue record of the disputed property.

Counsel for the petitioner-Mr. Abhishek Pareek submitted that the petitioners were caveator before the Board of Revenue and they have also filed application under Section 151 CPC wherein they have highlighted the fact of pendency of suit in respect of the same dispute between the parties before the revenue Court.

(3.) Counsel for the petitioner submitted that inspite of filing of the application under Section 151 CPC, the Board of Revenue has directed the parties to maintain status quo and has not taken up the application filed by the petitioners for passing of any order on the said application.
