JUDGEMENT

(1.) Heard the learned counsel for the petitioner, the learned Public Prosecutor as well as learned counsel for the complainant and perused the material available on record.

(2.) The petitioner apprehends his arrest in connection with FIR No. 49/2019 of Police Station Women, Jodhpur (East) for the offences punishable under Ss. 498-A and 406 I.P.C.

Learned counsel for the petitioner has submitted that allegations against the petitioner are to the effect that he along with his mother harassed the complainant for dowry and tortured her since the day of marriage. It is submitted that allegations of demand of dowry and misappropriation of Stridhan against the petitioner are false. Learned counsel for the petitioner has submitted that as a matter of fact, marriage of the complainant was solemnized with the petitioner on 2/12/2010, however, on account of some differences between them, the complainant is living separately from the petitioner since August 2013. Learned counsel for the petitioner has submitted that the petitioner never demanded dowry or ever harassed the complainant at any point of time. It is also submitted that at a point of time earlier the dispute between the petitioner and the complainant was amicably settled on 12/5/2014 and the father of the complainant gave in writing that all the Stridhan has been received by him. Learned counsel for the petitioner has further submitted that the petitioner had filed a divorce petition in the court of Gurgaon for giving divorce to the complainant and after receipt of summon of the divorce petition, this false FIR has been lodged against the petitioner. It is also argued that during the course of investigation, the petitioner has also joined investigation and, therefore, the custodial interrogation is not at all required. Learned counsel for the petitioner has, therefore, prayed that the petitioner may be enlarged on bail.
