JUDGEMENT

(1.) With the consent of the learned counsel for the parties, the matter is finally heard.

(2.) This misc. appeal has been filed by the appellant insurance company claiming the following reliefs:-

(3.) The unfortunate accident happened on 15.12.2003 when the deceased Raju went to switch off the generator and he got entangled in the machine, as a result whereof, he died.
