JUDGEMENT

(1.) State has filed this appeal challenging the order dated 21.12.2016, whereby the writ petition filed by the respondent no.1 was disposed of.

(2.) Learned State Counsel has submitted that the learned Single Judge has erred in reducing the quantum of punishment. In fact, the court had no power to reduce the quantum of punishment. In support of his his arguments, learned State Counsel has placed reliance on the decision of Hon'ble Supreme Court in B.C. Chaturvedi vs. Union of India and Ors, 1995 SCC (6) 749, wherein it has been held as under:-

(3.) Learned counsel for the respondent no.1 has opposed the appeal and has submitted that the order in question does not suffer from any illegality.
