JUDGEMENT

(1.) This writ petition is directed against the order dt.20.4.2009 whereby the learned trial Court dealing with the application under Order 39 Rule 2A C.P.C. deleted the name of respondent Jai Singh Parihar, A.En. on the ground that he has since retired from Government job.

(2.) Having heard the learned counsels and having gone through the reasons given in the impugned order, the deletion of name of Jai Singh Parihar under Order 1 Rule 10 C.P.C. cannot be faulted. This writ petition being devoid of merit is accordingly dismissed. NO order as to costs. A copy of this order be sent to the opposite party as well as the learned trial Court.
