JUDGEMENT

(1.) IN this appeal the appellants has raised the question pertaining to the interest. The interest has been allowed only in the event that the amount awarded by way of compensation is not deposited within a period of two months.

(2.) SHRI P. C. Sharma was given the notices of the appeal and he has accepted the same.

(3.) THE contention of the learned counsel for the appellants is that the question relating to the award of interest as well as the rate of interest and the effective date from which the same is to be awarded must be considered and decided by the learned Tribunal in the light of the answer given by the Division Bench of this court while answering the question No. 4, in the reference, in its judgment dated 10. 01. 2008 in the case of Union of India Vs. Smt. Shamim. It is submitted that similar appeals have already been remanded on the above question to the learned Tribunal for decision of the question pertaining to the award of interest afresh.
