JUDGEMENT

(1.) Issue notice for final petitioner.

(2.) Mr. O.P. Singaria, Public Prosecutor is directed to accept notice for the respondent-State. He accepts the notice. With the consent of learned Counsel for the parties, the matter is finally heard at admission stage.

(3.) By the instant criminal revision petition under Section 397/401 CrPC, the petitioner has challenged the judgment dated 09.07.2009 passed by Sessions Judge, Bhilwara in criminal Appeal No. 706/2009 whereby the appeal filed by the petitioner against the order dated 17.07.2006 passed by Additional Chief Judicial Magistrate, Shahpura, Distt. Bhilwara (for short "the trial Court") in criminal case No. 469/2002 convicting the petitioner for the offence under Section 498A IPC and sentencing him to undergo 2 years rigorous imprisonment and fine of Rs. 5000/-; in default of payment of fine to further under 4 months imprisonment, was dismissed only on the ground of delay in filing the appeal.
