JUDGEMENT

(1.) This order governs the disposal of bail application filed under Section 439 of Cr.P.C. by Mr. B.L. Mandhana Advocate on behalf of the applicant Bheru lal pertaining to F.I.R. No. 73/2009 at police station Shahpura, District Jaipur, in the offences under Sections 143, 147, 149, 283 and 353 of IPC.

(2.) Heard the learned counsel for the petitioner and learned Public Prosecutor appearing for the State and perused the material on record.

(3.) Learned counsel for the petitioner has canvassed that 13 co-accused persons of this case have already been enlarged on bail by this Court and the co-ordinate Bench. The case of the petitioner is similar to those of the co-accused persons. The petitioner has been in custody for the last two months. The case is still pending investigation, which is likely to take time, as such, on the ground of parity, he may also be granted indulgence of bail.
