JUDGEMENT

(1.) THIS order governs the disposal of bail application filed under Section 439 of cr. P. C. by Mr. Biri Singh Sinsinwar Advocate on behalf of the applicant Amar Singh pertaining to sessions Case No. 24/1993 pending before district and Sessions Court, Bharatpur, in the offences under Sections 399 and 402 of IPC as also under Section 4/25 of Arms Act.

(2.) HEARD the learned counsel for the petitioner, learned Public Prosecutor appearing for the State and perused the material available on record.

(3.) LEARNED counsel for the petitioner has canvassed that only one witness has been examined by the prosecution and eight witnesses are yet to be examined. In these circumstances, it is tangible that the trial is likely to take time. The petitioner has deposited Rs. 8,000/-under Section 446 of Cr. P. C. , however, he shall attend the trial regularly, hence, he may be granted indulgence of bail.
