JUDGEMENT

(1.) WRIT petition was dismissed vide order dt. 15/10/08 for not removing defect pointed out by the Registry within four weeks' time granted vide order dt. 14/08/08 against which instant application seeking restoration.

(2.) THIS Court has gone through the reasons assigned in the application which is duly supported by affidavit and sufficient cause has been shown for non-prosecution and the delay in removing defects, which is condoned.

(3.) CONSEQUENTLY, restoration application is allowed. Order dt. 14/08/08 and consequential order of dismissal dt. 15/10/08 stand re-called. CWP-01211/08 (def.) be restored to its original number. Office to proceed.
