JUDGEMENT

(1.) INSTANT petition has been filed by widow for fair consideration of her appointment for the post of Primary School Teacher pursuant to advertisement dt. 12/04/05 (Ann. 1 ).

(2.) PETITIONER qualified Secondary School examination with subjects of Hindi, English, general Science and social Studies in the year 1980 (Ann. 2) and Higher Secondary School examination from Board of Secondary Education rajasthan in 1982 (Ann. 4) besides Prathma from shri Vrihad Gujarat Sanskrit Parishad, Ahmedabad which is equivalent to Secondary School examination with subjects of Mathematics, science, Social Science, Advance Hindi and sanskrit in the year 1981 (Ann. 3 ). She also possessed qualification of B. A. (1988) from ajmer University and B. Ed (1990) from Kota Open university as avered in para 5 of the petition.

(3.) POST of Primary School Teacher under panchayati Raj Rules, 1996 (Rules, 1996) was advertised vide Ann. 1 dt. 12/04/05, pursuant to which, she being eligible submitted application but her candidature was rejected by respondents vide letter dt. 29/06/05 (Ann. 9) on the premise that she failed to qualify English subject at secondary School level.
