JUDGEMENT

(1.) Heard the learned counsel for the petitioners and the learned Public Prosecutor.

(2.) By this petition under Sec. 482 Cr. P.C., the petitioners have prayed that the trial pending against the petitioners in the court of learned Civil Judge (Jr. Division) and Judicial Magistrate, 1st Class, Padampur in Criminal Case No. 116 of 91 State vs. Ram Kishan & Ors., be quashed.

It appears that on the basis of the report filed by Shri Mander Singh, the then Patwari ol Halka Fakirwali, the FIR No. 88/90 was registered at Police Station, Ghamoorwali in respect of offences under Secs. 393, 353, 332 and 342 read with 34 IPC. After completion of investigation, the police submitted a charge- sheet under Sec. 173 Cr. P.C. against the accused persons in respect of offence punishable under Secs. 332, 353 and 342 read with 34 IPC in the court of learned Civil Judge (Jr. Division) and Judicial Magistrate, 1st class, Padampur. A protest petition was also filed by the complainant on 11.4,1991. After hearing the arguments, the learned Judicial Magistrate took cognizance of the offences under Secs. 392, 353 and 332 read with 34 IPC against the accused persons.
