JUDGEMENT

(1.) This revision petition is directed against the judgment dated 6.6.98 passed by Addl. Sessions Judge No. 1, Sri Ganganagar whereby he upheld the conviction of the petitioner under section 7/16 of the Prevention of Food Adulteration Act, and sentence of six months S.I. and a fine of Rs. 1000.00 recorded by the Chief Judicial Magistrate, Sri Ganganagar vide judgment dated 17.7.96.

(2.) It is not necessary to mention the facts of the case in detail as Mr. Garg does not challenge the conviction of the petitioner. His only submission is that looking to the fact that sample was taken in 1988, the period of imprisonment already undergone by him, may be held sufficient.

(3.) I have carefully gone through the record of the case. By the testimony of Ramswaroop, Food Inspector it is fully established that he had purchased milk from the petitioner for analysis and had sealed the same in three bottles. The Public Analyst's report indicates that the sample was adulterated as it did not conform to the prescribed standard. There is no reason to disbelieve the prosecution evidence.
