(1.) Four cases are pending against the petitioner under section 3 of the Railways Property (Unlawful Possession) Act. He remained absent in these cases and ultimately was arrested on 15.3.88. According to him he could not appeared in the court due to his illness, Now he is in custody for last about eight months. It is contended that suitable conditions may be imposed and he shall appear regularly. It is also stated that he sales fruit on Thela and he is a permanent resident of Ajmer.
(2.) Considering that he has remained in custody for more than eight months and the nature of the case does not require that he should remain in custody, he can be released on heavy bail by imposing suitable conditions.
(3.) It is, ordered that the accused petitioner Manoj be released on bail if not wanted in any other case, provided he furnishes a personal bond in the sum of Rs. 10,000 (Rupees Ten Thousand) with two sureties in the sum of Rs. 5,000.00 each to the satisfaction of the trial court with the stipulation to appear before that court during the course of trial in this case on the further conditions :
