ASHOK KUMAR Vs. STATE OF RAJASTHAN

Decided On April 25, 1988
ASHOK KUMAR Appellant
V/S
STATE OF RAJASTHAN Respondents

JUDGEMENT

(1.) EVEN as per the case of the petitioner he was initially appointed as Helper though the work of Lower Division Clerk was being taken from him. So long as the petitioner worked as L. D. C. he is entitled for the wages of that post on the principle of equal pay for equal work; but that cannot mean that the petitioner was appointed/recruited as L. D. C. For appointment/recruitment proper procedure is prescribed. Hence, mere working on the post of L. D. C. does not mean that the petitioner was appointed as L. D. C. regularly by follow-ing the procedure prescribed for such appointment. We are of the opinion that the petitioner was initially appointed as helper and his mere doing the work of L. D. C. does not entitle him to hold the post of L. D. C. on regular basis.

(2.) WITH these observations, this writ petition is dismissed summarily. .
