JUDGEMENT

(1.) The accused, aged about 17 to 18 years, has been convicted under section 376, Indian Penal Code, and sentenced to rigorous imprisonment for three years and to pay a fine of Rs. 1,000.00 with a default sentence. He has been in jail for more than seven months.

(2.) Taking his age into consideration I reduce the sentence to the period already undergone. I set aside the sentence of fine, and direct that the accused be set at liberty forthwith. With this modification in sentence this appeal is dismissed. Appeal dismissed.
